Reports indicate a significant struggle between a San Jose police officer and a suspect led to a gun being discharged several times Friday morning, sending the officer and suspect to the hospital. The incident took place near Leigh Avenue and Stokes Street in San Jose.

San Jose police received a 911 call of suspicious persons in a driveway. An officer who arrived at 10:54 a.m. confronted one of the individuals and a struggle ensued in which the suspect tried to take the officer’s gun.

In what police spokesman Jason Dwyer described as “a life or death struggle” with the unidentified suspect, the gun discharged several times during the struggle and the officer suffered powder burns to the hand.

The officer suffered other injuries in the struggle and was transported by ambulance to the hospital.

The suspect ran away attempting to escape but was captured by other responding officers. The suspect was also transported by ambulance to another hospital.
